Commercial Litigation

  • Represented health insurance company in multimillion dollar litigation against technology services provider for breach of license and services agreement.
  • Defended semi-conductor chip design services company in multimillion dollar action against claims of infringement, trade secrets, theft, breach of contract and fraud. Plaintiff voluntarily dismissed case after significant discovery and motion practice.
  • Defended retailer in action for breach of contract and other business torts.
  • Represented construction contractor in dispute with leading national specialty communications company for breach of contract relating to three projects in California.
  • Represented plaintiff building products manufacturer in obtaining jury verdict recovering damages for inferior grade of paint in construction-related products liability action.

Real Estate Litigation

  • Defended real estate developer in commercial lease dispute involving claims for breach of contract and interference with prospective economic advantage.
  • Represented plaintiff real estate developer in commercial lease dispute involving claims of fraud and interference with contractual relations.
  • Represented commercial landlord in unlawful detainer action against tenant.
  • Represented real estate developer in action against homeowners’ association to enforce CC&Rs and architectural design guidelines.
  • Represented homeowners’ association in litigation against developer and builders of condominium complex arising out of defects in the construction, design and specifications of the property.
  • Represented property owners in residential partition actions.
  • Represented landowner whose property was condemned for massive flood control project in legal challenge to the condemning agency’s right-to-take, on the grounds that the property was not necessary to achieve 100-year flood protection or for the overall success of the project.
  • Represented national warehouse chain in action against public entity to recover remediation costs and damages for inverse condemnation and various torts resulting from contamination of client’s property.
  • Defended former owner of industrial site in action to recover environmental response costs pursuant to CERCLA and the Polanco Redevelopment Act. Prosecuted claims of contribution and indemnity against other former site owners and operators.
